What should I do if I need assistance after submitting my case independently?

Once we have assessed the status of your self-application, we will determine the next steps to be taken and assist you with submitting all required docments within the government deadlines set for your case.

I understand that you don't need to hire a lawyer or consultant to apply for Canadian permanent status. Is this a genuine claim?

Candidates for Canadian permanent status are not required to employ a lawyer or consultant and while some candidates apply and succeed independently, many endure excessive delays or fail the application process.

The Canadian government’s policies and practices are subject to change at any given time. An immigration officer’s decision must consider a wide range of concerns addressed by government manuals, as well as ad hoc modifications. Lawyers and consultants frequently contested these rulings, resulting in a large body of reported case law. Good consultants can defend applicants’ rights

“When lawyers and consultants present their client’s claims straightforwardly and concisely, the processing is expedited and simplified.”

What's the difference between working with a non-licensed consultant versus a licensed one?

The term “individual” denotes someone who is asked for counsel. Licensed consultants are permitted to carry out:

  • Legal duties
  • Drafting documents
  • Interpreting and applying laws
  • Giving legal advice
  • Representing clients in Tribunal
  • Providing legal representation.

Each province has its own set of rules and regulations governing immigration practitioners. The Letter of Authority from the designated regulatory agency is required for a consultant.

The Immigration Consultants of Canada Regulatory Council (ICCRC)oversees the professional conduct of immigration consultants in Canada. For example, the ICCRC’s guidelines address: the obligations of consultants to their clients, the performance of mandates, and the use of separate trust bank accounts for client fees.

If a consultant breaks these guidelines, their license may be revoked or suspended. Anyone offering immigration advice for a fee must be a member of the organizations listed below:

  • The Canadian Society of Immigration Consultants (CSIC) was replaced in 2011 by the Immigration Consultants of Canada Regulatory Council (ICCRC).
  • Licensed immigration advisors in Canada must pass a far more difficult admissions procedure before practice. Immigration consultants require extensive training and are subject to the same level of scrutiny as other professionals. Customers who are dissatisfied with the work of a consultant can file formal complaints against them with the ICCRC’s compensation fund.

Immigration, Refugees and Citizenship Canada (IRCC) and a specific visa office place some consultants claim to have connections. In my country, this may be significant. The same applies to Canadians, isn't it?

This isn’t true in Canada. Government, legislature, and judiciary all operate independently in Canada. Parliament holds ministers to account. The legislature grants the government authority to enforce the rules and regulations that regulate the citizens of Canada in several areas, including immigration. Using the law demands a degree of discretion.

The impartiality and independence with which government officials make decisions are basic tenets. If public officials are determined to lack objectivity, they may be held accountable. For professing to influence public officials, private individuals face punishment. An applicant should not hire a person who claims to be affiliated with the government.

Why should I engage an Immigration Consultant to assist me in moving to Canada?

Canada’s immigration laws and standards allow immigration officials to have a great deal of discretion if they do so within specific parameters. Visas can be issued more quickly if the application is precise and brief, addressing the most critical points. Examples

Highly trained workers
There are several positions in the skilled worker category that can be applied for without a formal offer being made. The visa officer must approve the candidate’s work experience and rating. If you hire a consultant, they’ll know just what to emphasize to get your desired result.

Company divisions
To be considered for a job in the business field, a candidate must have previous experience operating a business. Visa officers may come to different conclusions based on the information at their disposal. Managing a significant corporation department may or may not qualify as a managerial position, depending on one’s perspective. It is the skill of an experienced immigration counselor that sets them apart from others in the field. Canada’s immigration policy is constantly evolving to accommodate the needs of the current administration.

On the other hand, Visa offices have their own set of rules, which aren’t made public. These prerequisites could determine whether or not you will be successful. A Canadian immigration counselor will handle any issues at the applicant’s discretion in the application. Additionally, a consultant can point out any flaws in the evaluation process that can be fixed without resorting to formal legal action. A family’s entire trajectory is altered when they decide to relocate to Canada. To optimize the benefits and provide advice on challenges that may arise after obtaining permanent status, an immigration consultant might be hired.

What factors should I consider when looking for a consultant?

Many of Canada’s most prominent legal firms do not offer immigration services. Instead, many independent lawyers and consultants are involved in this field of law.

The following are possible research questions to ask when looking for a good consultant:

Referrals/References
Here we have the most solid evidence. Customers pleased with their service are more likely to recommend it to others. A qualified consultant should provide references from previous clients who were happy with their services.

Experience

Others have a lot of experience. Although this does not necessarily equate to competence,it is still a significant aspect in determining one’s level of knowledge.

Contract
All professional organizations mandate this. Your consultant should provide you with a clear written contract.
An arrangement where money is held “in trust.”
Fees should be paid to the consultant “in trust” by applicants.
Professional Orders require this as a prerequisite.
The Professional Order monitors a separate trust account for client fees. This is a good sign that the consultant in issue is up to date with the law.

Advertising
In some cases, advertising is the best way to find a consultant. A prospective client’s selection of a lawyer should not be solely based on the advertising they see. First, carry out a more thorough investigation.

The majority of Internet Consultants have their websites to advertise their services. Consultants well-known in their fields are likely to have a robust online presence. It’s essential to look for experts who regularly post content on websites that provide in-depth knowledge. Avoids consultants who have only a few old pages and a lot of government-sourced content on their websites. On a consultant’s website, their knowledge should be evident. There are also free evaluations available that might give you a general idea of your possibilities of success in your chosen field.

Direct exchange of ideas
Professionalism can be discerned just by speaking with a consultant.
The level of service, dedication, and insight are all immediately apparent.
Ensure that the consultant has a clear picture of what is going on at hand.

Is it essential where a lawyer practices law in Canada?

For the most part, the answer is no.

Although provinces share some authority in this area, immigration law is a federal issue.

Membership in one of the following organizations is required to provide immigration advice:

An organization is known as CICC, formerly known as the Canadian Society of Immigration Consultants (CSIC), established in 2011 to replace the CSIC.

The Canada-Quebec Accord of 1991 mandates that Quebec governs its immigration.

*It’s important to know that only the following individuals are permitted to represent you before Quebec’s Ministry of Immigration:

• Members of the Barreau du Québec • members of the Chambre des notaires du Québec • people granted special authority by one of the two organizations
